UA Consumer Addendum

Purpose and scope
This addendum applies to consumers located in Ukraine or otherwise benefiting from mandatory Ukrainian consumer-law protection.
It supplements Dumka's Terms and prevails for mandatory Ukrainian-law matters.
It reflects Ukraine's Law on Digital Content and Digital Services No. 3321-IX, Consumer Protection Law No. 1023-XII, E-Commerce Law No. 675-VIII and Personal Data Protection Law No. 2297-VI.
A. Seller and pre-contractual information
A.1. The seller and Merchant of Record is Oleks Tech OÜ, registry code 17290539, address Sinika tee 15-2, Järveküla, Rae Vald, Harjumaa, Eesti 75304, [email protected], unless expressly stated otherwise.
A.2. Before payment, Dumka provides information about the product name, Coach as content supplier, description, functionality, compatibility, technical requirements, DRM or restrictions, access term, price, currency, taxes/fees, payment process, withdrawal rights, conformity remedies, support, complaints and contacts.
A.3. The electronic contract is concluded through the user's actions in Dumka and/or Stripe Checkout. Dumka records the terms version, date/time, IP, User-Agent and order ID.
B. 14-day withdrawal and immediate access
B.1. If access to digital content has not started, the consumer may withdraw within 14 calendar days with a refund unless applicable law provides otherwise.
B.2. Because Dumka normally provides access immediately after payment, checkout contains separate explicit consent to start digital-content delivery before 14 days expire and separate acknowledgement of losing the withdrawal right once access starts.
B.3. If the user does not provide this separate consent, Dumka does not provide immediate access through standard checkout until delayed delivery or another lawful scenario is implemented.
B.4. Loss of withdrawal right does not limit consumer remedies for non-conformity, material defect, unauthorized charge or another legal breach.
C. Conformity of digital content
C.1. Digital content must conform to the description, functionality, compatibility, technical requirements and characteristics communicated before contract conclusion.
C.2. Dumka and Coaches cooperate to provide updates, security fixes or other remedies for non-conformity within a reasonable time.
C.3. If content does not conform, the consumer may request conformity, price reduction, refund, termination or another remedy under applicable law.
C.4. If an update or modification degrades access, functionality or compatibility beyond what the contract and law allow, the consumer receives appropriate remedies.
D. Complaints and refunds
D.1. Claims, refund requests, receipt/invoice questions and complaints should be sent to [email protected].
D.2. Initial response is provided within 14 calendar days unless the law requires a shorter period.
D.3. If a refund is approved, funds are returned through the same payment method where technically possible. Settlement timing depends on Stripe, the bank and the card network.
D.4. The consumer may also contact competent Ukrainian consumer-protection authorities or a court under Ukrainian jurisdiction rules.
E. Personal data
E.1. Ukrainian users' personal data is processed under Dumka's Privacy Policy, the GDPR where applicable and Ukraine's Personal Data Protection Law.
E.2. Requests for access, rectification, erasure, restriction or other privacy rights should be sent to [email protected].
F. Version
F.1. Version of this addendum: 05.05.2026. If Ukrainian consumer law changes, Dumka updates this addendum and applies mandatory rules regardless of the text-update date.
